1. Acceptance of Terms

Welcome to Prosthetic Tracker. By accessing or using our prosthetic tracking platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Prosthetic Tracker ("we," "our," or "us"). Please read them carefully.

2. Description of Service

Prosthetic Tracker is a web-based platform designed to facilitate communication and tracking of dental prosthetic work between dental practices, dental laboratories, and patients. The Service provides:

  • Job creation and management for dental prosthetic work
  • Milestone tracking and progress updates
  • Communication tools between dental professionals and labs
  • Patient tracking portals using unique tracking codes
  • Practice and user management features

Important: Prosthetic Tracker is a communication and tracking tool only. It does not provide medical advice, diagnosis, or treatment. All clinical decisions remain the responsibility of licensed dental professionals.

3. User Accounts and Registration

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized access or security breach
  • Accept responsibility for all activities that occur under your account

3.2 Account Types

  • Super Admin: Full system access and management capabilities
  • Dental Practitioner: Can create jobs, manage practices, and view patient progress
  • Lab Technician: Can view assigned jobs, update milestones, and manage progress
  • Patient (Public): Can track job progress using tracking codes (no account required)

3.3 Professional Credentials

Users registering as dental practitioners or lab technicians represent and warrant that they hold valid professional licenses and credentials required to practice in their jurisdiction. We reserve the right to verify credentials and may suspend or terminate accounts if credentials cannot be verified.

3.4 Account Approval

New accounts require administrative approval before full access is granted. We reserve the right to reject any registration or terminate any account at our discretion.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Violate any applicable laws, regulations, or professional standards
  • Infringe on the intellectual property rights of others
  • Upload or transmit viruses, malware, or other malicious code
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Interfere with or disrupt the Service or servers
  • Use the Service to send spam, unsolicited communications, or advertising
  • Impersonate any person or entity or misrepresent your affiliation
  • Collect or store personal data about other users without permission
  • Use automated systems (bots, scrapers) to access the Service
  • Share patient information in violation of privacy laws or professional ethics

5. Healthcare Compliance and Professional Responsibility

5.1 HIPAA and Privacy Compliance

Users who are healthcare providers are responsible for ensuring their use of the Service complies with applicable privacy laws, including but not limited to HIPAA (Health Insurance Portability and Accountability Act) and other relevant regulations in their jurisdiction.

5.2 Professional Standards

Dental professionals using the Service must comply with all applicable professional standards, codes of ethics, and licensing requirements. The Service does not replace professional judgment or clinical decision-making.

5.3 Patient Consent

Dental practices are responsible for obtaining appropriate patient consent before entering patient information into the Service or providing patients with tracking codes.

5.4 Accuracy of Information

Users are responsible for ensuring the accuracy and completeness of all information entered into the Service, including job details, measurements, and progress updates.

6. Intellectual Property Rights

6.1 Our Intellectual Property

The Service, including its design, features, functionality, text, graphics, logos, and software, is owned by Prosthetic Tracker and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

6.2 Your Content

You retain ownership of any content you submit to the Service (job descriptions, notes, measurements, etc.). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content solely for the purpose of providing the Service.

6.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without any obligation to you.

7. Payment and Subscription Terms

If applicable to your account type:

  • Subscription fees are billed in advance on a recurring basis
  • You authorize us to charge your payment method for all fees
  • Fees are non-refundable except as required by law
  • We may change fees with 30 days' notice
  • Failure to pay may result in suspension or termination of your account

8. Disclaimers and Limitations of Liability

8.1 No Medical Advice

THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL OR DENTAL ADVICE, DIAGNOSIS, OR TREATMENT. The Service is a communication and tracking tool only. Always seek the advice of qualified healthcare providers with questions regarding medical or dental conditions.

8.2 Service Provided "AS IS"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROSTHETIC TRACKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

8.4 No Guarantee of Accuracy

While we strive to provide accurate and reliable service, we do not guarantee that the Service will be error-free, uninterrupted, or free from technical issues. We are not responsible for errors or omissions in user-submitted content.

9. Indemnification

You agree to indemnify, defend, and hold harmless Prosthetic Tracker, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of applicable laws or professional standards
  • Content you submit to the Service

10. Termination

10.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature. Upon termination, your access to the Service will cease.

10.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if:

  • You violate these Terms
  • You fail to pay applicable fees
  • Your account is inactive for an extended period
  • We are required to do so by law
  • We decide to discontinue the Service

10.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and content, subject to legal retention requirements. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

11. Modifications to the Service and Terms

11.1 Service Changes

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
